Welcome to https://nativehistoryproject.org (the “Site”), operated by the Alameda Native History Project (“we,” “us,” or “our”). By accessing or using this Site, you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site.
1. Mission and Use
The Alameda Native History Project is an Indigenous-led initiative focused on land stewardship, education, cultural revitalization and accountability. You agree to use this Site in a way that respects our mission, our sovereignty and the integrity of our work.
2. Intellectual Property
All original content on this Site, including research, writing, maps, graphics, educational materials and project designs, is protected by copyright and intellectual property law.
You may:
- Cite or reference our work with proper attribution and a direct link
- Use materials for educational purposes consistent with our mission, with credit
You may not:
- Copy, reproduce, sell, republish or modify our content without permission
- Use our work for branding, identity claims, performative land acknowledgments or programs that misrepresent Indigenous perspectives
- Train AI, scrape our site or create derivative works without explicit consent
3. Respect for Indigenous Data and Cultural Protocols
You agree to uphold Indigenous data sovereignty and refrain from extracting, remixing or misrepresenting cultural or community information shared here. This is not open source. This is not public domain. This is Indigenous work, held in trust.
Violating this will trigger immediate enforcement action.
4. Community Guidelines
By interacting with us or using our content, you agree to:
- Respect Indigenous leadership, boundaries and lived experience
- Refrain from harassment, tone policing, trolling or extractive engagement
- Follow all stated expectations for participation at events or in programs
We reserve the right to restrict access to the Site, events or services at our discretion.
5. Third-Party Services
We use trusted service providers to support our operations. These include:
- Hack Foundation (doing business as “Hack Club”) for fiscal sponsorship and donation processing
- Omnisend for SMS and email communications
- EmailOctopus for newsletters
- Google Forms and Sheets for registration
- Google Analytics for basic web metrics
Each provider has its own terms and privacy policy. We do not authorize unrelated use of your data by these services.
6. SMS and Mobile Communications
If you sign up to receive text messages from us, you consent to receive SMS communications for purposes including event reminders, safety updates, volunteer coordination and donation alerts. Messages are sent via Omnisend, our SMS platform.

We do not sell, rent or share your phone number with unrelated third parties. Use of SMS is subject to both these Terms and our Privacy Policy.
7. Enforcement and Legal Action
We take misuse seriously. If you:
- Steal, misrepresent or profit from our intellectual property
- Forge tribal affiliation or fabricate Indigenous identity using our content
- Misuse our materials in violation of these Terms
We will pursue all available legal remedies, including cease-and-desist orders, DMCA takedowns, public exposure and civil litigation.
We have successfully defended our work before. We will do it again if needed.
8. Disclaimers
We make no guarantees about the completeness or accuracy of content on this Site. Historical research and cultural materials are offered to the best of our ability and may evolve over time. Use this Site at your own risk. We are not liable for any damages or losses resulting from your use or inability to use the Site.
9. Changes to the Terms
We may revise these Terms from time to time. Updated versions will be posted here with a revised date. Continued use of the Site means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of California. Any disputes will be resolved in Alameda County, California.
